Seventh District affirms Carroll County ruling in dispute over royalty payments tied to 2008 Patriot Energy Partners lease
A May 19, 2025, judgment by Carroll County Common Pleas Court Judge Michael V. Repella II to stay a case involving a Buckeye Boy Scout Foundation oil and gas lease has been affirmed by the Seventh District Court of Appeals.
In a 112-page opinion filed in the Carroll County Clerk of Courts office, the appeals court overruled an assignment of error sought by the Buckeye Boy Scout Foundation and upheld the lower court’s decision to stay proceedings. The stay was ordered in connection with a complaint filed Dec. 10, 2024, by the foundation against Encino Energy LLC, EAP Ohio LLC and EAP Operation LLC of Houston, Texas. The dispute involves an Aug. 25, 2008, oil and gas lease with Patriot Energy Partners LLC and EAP Ohio LLC that contains an arbitration provision.
In its complaint, the Buckeye Boy Scout Foundation sought an accounting of royalty payments, the methods used to calculate those royalties and the facts underlying the calculations. The royalties relate to payments made to the foundation for oil and gas production on 892 acres of property it owns in East Township, Carroll County.
