Harrisville sewer hearing delayed to Sept. 9

A court hearing involving the Harrisville sewer system has been delayed for several more months after a scheduled June 9 injunction hearing was continued.

Harrisville Mayor Shari Friend attended the hearing along with several attorneys, including representatives of the Ohio Attorney General’s Office from Columbus. Rather than proceeding with the anticipated court hearing, attorneys met in chambers.

According to the Harrison County Common Pleas Court docket, the matter has been continued until Sept. 9. The next hearing is scheduled to be conducted by telephone conference.

Attorney Nora M. Baty is representing the Ohio Attorney General’s Office, while Katherine M.K. Kimble represents the Village of Harrisville.

Friend said a town meeting will be held at 7 p.m. June 22 in the community building to discuss the sewer system. She encouraged property owners and anyone connected to the village sewer system to attend.

In a separate case heard earlier in the day, Coda L. Boyd rejected a plea offer from the state for a second time.

Boyd is charged with one count of rape, a felony; one count of sexual battery, a third-degree felony; and one count of gross sexual imposition, a fourth-degree felony.

Details of the plea offer were not disclosed in court.

A jury trial has been scheduled for 9 a.m. Oct. 21.

Public Defender C. Adrian Pincola told the court Boyd intends to retain private counsel for trial. Judge T. Shawn Hervey noted a continuance could be granted if new counsel files an appearance in the case.

“If you’re going to hire an attorney, the time to do that was a long time ago, but if you’re doing it now, you better do it soon,” Hervey told Boyd.

At a previous hearing, Assistant Prosecutor Lauren Knight advised the court the plea offer would remain available only until the final pretrial hearing. Following Boyd’s rejection of the offer, Knight indicated it is no longer available.
