Appeals court sides with Gateway Royalty in Carroll County oil and gas lease case

The Seventh District Court of Appeals has affirmed a Carroll County Common Pleas Court judgment in favor of Gateway Royalty LLC of Amarillo, Texas, against EAP Ohio LLC of Houston, Texas, in a dispute over oil and gas drilling leases.

The Dec. 3, 2024, summary judgment barred EAP Ohio from deducting costs from its overriding royalty interest payments to Gateway, specifically post-production costs.

The appeals court said the case adds to a growing body of Ohio litigation involving overriding royalty interests.
