Fetty ordered held on $40,000 bond in probation violation case

Judge says Fetty could face up to 30 months in prison if found guilty of violating probation terms

Devin Fetty was originally indicted Oct. 2022 for aggravated possession of drugs, a fifth degree felony. He spent some time in jail before being furloughed to an inpatient treatment facility May 2023. By June, the state filed a motion to revoke bond because he had left the facility and his whereabouts were unknown. Five months later he was arrested again. 

Pleading guilty, he was sentenced in January 2024 to two years probation, completion of the program at Eastern Ohio Correction Center, and 80 hours of community service.

Fetty appeared via video call from the Monroe County Jail for an evidentiary hearing on a motion to revoke probation that was filed in Mar. 2025.

Judge Shawn Hervey presided over the case and read the indictment against Fetty, “It basically says that you haven’t reported, they didn’t know where you were, and you still owe money.”

Fetty began asking questions but Hervey stopped him, explaining he would have an opportunity to speak soon. Hervey explained Fetty’s constitutional rights and Fetty said he wanted an attorney.

“The possible penalties in this matter,” Hervey said. “Is the imposition of the balance of your reserved prison sentence. The reserved prison sentence is 30 months. So whatever’s left of that 30 months, and I imagine it’s a substantial amount, could be imposed against you if you’re found to have violated your community based control.”

Hervey entered a denial on Fetty’s behalf. This preserves Fetty’s rights while he fills out the paperwork for appointed counsel or procures the funds for an attorney.

Hervey next went over bond, hearing first from the state, represented by prosecuting attorney Lauren Knight.

“This is a case where we would request a monetary bond,” said Knight. “The motion was filed by the case back in March of this year but obviously the allegations contained therein state that we have not had contact with him since July 26, 2024, which is over a year now. The state would request a monetary bond in the amount of $40,000 with the 10% cash option.”

Hervey followed the state’s recommendation, setting bond at $40,000.
