Lack of Delta-8 regulation poses a threat

As a member and chair of the Tuscarawas County Empower Tusc Coalition, I am writing to raise awareness about the potential harms associated with Delta-8 hemp products.
Delta-8 THC, a compound derived from hemp, has gained popularity due to its psychoactive effects, which are similar to those of Delta-9 THC found in marijuana. Delta-8 and Delta-9 THC are chemically similar but differ in their molecular structure. Additionally, Delta-8 is often synthesized from hemp-derived CBD, whereas Delta-9 is a major constituent of the cannabis plant.
Companies also are introducing other psychoactive hemp products like Delta-10 THC, THC-O and THC-a. These products further complicate the regulatory landscape and pose additional risks to consumers.
Delta-8 THC products are being sold in gas stations and other easily accessible locations, often without age verification. Additionally, these products are frequently packaged in ways that appeal to children such as gummies, chocolates and candies.
According to “Monitoring the Future Data, 2023,” 11.4% of 12th-graders reported using Delta-8 THC in the past year. This statistic is alarming and emphasizes the need for increased awareness and regulation to protect our youth.
There are several concerns regarding the safety and regulation of Delta-8 products that consumers should be aware of:
—Lack of regulation: Delta-8 products are often marketed without proper regulatory oversight. This means there is no guarantee these products contain what their labels claim. As a result consumers may be exposed to harmful contaminants such as heavy metals, pesticides and mold.
—Health risks: The FDA has not evaluated or approved Delta-8 THC products for any use. Reports have indicated these products can cause adverse health effects including accidental poisoning. Between December 2020 and February 2022, the FDA received 104 reports of adverse events related to Delta-8 THC, highlighting the potential risks.
—Psychoactive effects: Despite being marketed as a milder alternative to Delta-9 THC, Delta-8 can still produce significant psychoactive effects. This can lead to impaired judgment and coordination, posing risks especially when operating vehicles or machinery. Some products labeled as hemp or CBD may contain Delta-8 THC without clear labeling, misleading consumers about the product’s content and effects.
Delta-8 THC and similar products represent the fastest growing segment of the marijuana THC market.
Given these concerns, it is crucial for consumers, parents and grandparents to be informed about the potential risks associated with Delta-8 hemp products. We urge regulatory bodies to implement stricter oversight and for consumers to exercise caution when considering these products.
